Human Nature is Unpredictable
Agudengba and Chu Sanxing sat under a big tree by the
Salween River and talked about the chaotic phenomenon of porcelain.
Agudengba shared his views on the chaos of porcelain:
Speaking of Lei Feng, everyone in China knows it, but nowadays it is difficult
for the media to find a "living Lei Feng" because Lei Feng is
difficult to resurrect. However, overseas media people actually found a
"live thunder feng" in California, the United States, and that was
the Good Samaritan.
The story has to start with the "Porcelain
Porcelain Case in California, USA":
In 2004, on Halloween night, a young woman named
Alexandra crashed her car into a telephone pole on the side of the road. The
car emitted thick smoke and was likely to explode. At this time, Alexandra
Radka could not move in the car. Her colleague Lisa was in a car following her.
Upon seeing this, she rushed to the rescue and pulled out Alexandra who was
stuck in the car. Lisa said afterwards that the car had the potential to
explode, so she desperately dragged Alexandra out of the car. Alexandra was
paralyzed after a car accident and could only rely on a wheelchair, and her financial
income was extremely limited.
In 2008, Alexandra sued Lisa, her colleague who
dragged her out of the car, to court, claiming that Lisa used excessive force
when pulling her out of the car, which caused her paralysis, so Lisa was
responsible for her paralysis. . The California District Court did not accept
the lawsuit, and Alexandra's lawyers took the case all the way to the
California Supreme Court. On December 19, 2008, the California Supreme Court
ruled 4:3 that the court could accept Alexandra's case against Lisa.
This ruling of the California Supreme Court caused an
uproar in society and public opinion. The public's views are almost one-sided.
People who do good deeds cannot be punished. Even good-hearted people make
mistakes when helping others. At the same time, the California Assembly also
responded. On June 25, 2009, the California Assembly passed the "Good
Samaritan Exemption Ordinance" by a vote of 75:0. The bill came into
effect on August 6, 2009. Faced with the new bill, Alexandra could only
withdraw the accusation against Lisa.
Agudengba said to Chu Sanxing:
The cases of well-meaning people helping others in
China and the United States are all morally about whether to care about others
and lend a helping hand to the best of their ability. Like an old man falling
to the ground, it is the most normal thing to give him a hand. But the focus of
the dispute in the Chinese case is: the person who helped someone said that he
was helping someone, while the person who fell said that she was knocked down
by the helper. This became everyone's story, but judging from the facts, it
should be It was a lie told by one party, and its nature expanded from the
moral level to the legal level.
Agudengba told Chu Sanxing a story about a Chinese
woman who helped others but was framed:
One night, Ms. Lei drove past the intersection of Line
5 in Tiantongyuan and saw an old man fallen on the roadside with lunch boxes
scattered on the ground. After questioning, she found out that the old man was
a little dizzy because he was drunk. Ms. Lei Immediately I felt that this old
man was really in danger here, so I called the police. The police arrived about
half an hour later. Before the police came, our kind Ms. Lei stayed with the
old man and talked to him. Who knew that the police would When the police
arrived, the old man told the police that Ms. Lei had hit him. Ms. Lei was so
heartbroken that she had to go to the Tiantongyuan Traffic Police Team to take
an alcohol test and give a thorough explanation before returning home.
Although the traffic police later investigated the old
man's body and Ms. Lei's car, there were no signs of a collision. The traffic
police staff said that it was not Ms. Lei who had hit the car. However, Ms. Lei
still felt aggrieved, so she successively posted a request for help on Weibo.
The witness’s Weibo has been forwarded many times by netizens, but so far it
has not been found. Ms. Lei said that no witnesses have been found. "I
really want to find witnesses who can stand up and clear my name."
Agudengba sighed: "The evildoers do not get bad
rewards, but those who help others do not get good rewards. Obviously this is
one of the reasons for the gradual disappearance of "Living Lei
Feng".
He added to Chu Sanxing: However, in the American
case, both parties acknowledged the fact that the injured person was pulled out
of the car by the person being helped. The dispute was whether the help caused
further injuries to the person being rescued due to negligence. Injury, ethics
and responsibility all become questions of how the law is applied.
In order to protect the virtues and behaviors of good
Samaritans who help others, and to prevent them from getting into trouble or
being sued in court if they do good deeds, there is a law in the United States
specifically designed to protect good Samaritans. This law is called "Good
Samaritans" Samaritan Law.
Agudemba talked about the story of the Good Samaritan
that the Good Samaritan Law originated from.
It turns out that a Good Samaritan refers to a
kind-hearted, kind-hearted and helpful person who sympathizes with and helps
those in need. This kind of good Samaritan refers to a person who has neither
legal nor contractual obligations, but out of inner moral requirements, helps
or rescues others free of charge. In today's terms, the Good Samaritan should
be called "Living Lei Feng".
The "Good Samaritan Act" is a legal
provision that exempts rescuers from liability when their free rescue actions
cause some damage to the rescued person during an emergency. It is included in
both federal and state laws in the United States. Some of the relevant legal
provisions are called the "Good Samaritan Law" and some are called
the "Free Rescuer Protection Law." The Good Samaritan Law generally
provides immunity from liability for strangers' mistakes in providing emergency
medical treatment to injured people, and does not require legal liability for
the injuries caused. This situation must be at the scene of an emergency, and
such assistance is free of charge. In principle, the Good Samaritan Law focuses
on protecting medical personnel, police, and firefighters from having to bear
civil liability for problems that arise during rescue operations during
emergencies or accidents, unless the above-mentioned personnel are negligent.
The rescue or rescue method is clumsy or deliberately delayed.
In the United States, if a person has not received
special first aid training, in principle, even if he encounters a situation
that requires first aid, he should not take action easily. Because if a person
is not trained in first aid, there is no legal obligation to provide first aid
to an injured person. However, some state laws stipulate that if a person does
not call 911 when he discovers a stranger is injured, he may be guilty of a
minor crime of negligence. The general rule is that if a person is injured and
unconscious, strangers may administer first aid without the injured person's
permission. If a person is injured but still conscious, strangers must obtain
the injured person's permission before helping. In some states in the United
States, if a stranger carelessly causes the injured person's injury to worsen
when rescuing an injured or sick person, it may still be considered a minor
crime of negligence.
Therefore, even if there is a "Good Samaritan
Law" in the United States, people still need to pay attention when helping
others under special circumstances. They should not think that helping others
with good intentions will not incur civil liability. When a person helps an
injured stranger, the "Good Samaritan Law" has its own strict legal
provisions. When a good Samaritan rescues an injured person, he legally has a
need for the person being rescued. Duty to rescue reasonably and with care.
Agudengba said: As for the old man who fell and
strangers want to help the old man stand up, in order to avoid such things as
"touching porcelain", it is best to ask the other person if he needs
help before helping. If the other person says no, it is best to ask him if he
needs help. It's best not to do anything. If you want to help the elderly, it
is best to have witnesses nearby. The most critical point here is that people
cannot be without kindness, but they must also learn to protect themselves. As
for cases like those in China where people insist on different opinions, the
most convincing thing is probably to find witnesses at the scene or see whether
there are images captured by surveillance cameras. If there are none, then the
question may only be answered by the conscience of the person concerned. For those
who "touch porcelain", society should condemn this evil behavior and
deal with it seriously in accordance with the law.
"Evil will be rewarded with evil, and good will
be rewarded with good." But out of good intentions, you accidentally
rescued a troubled person, but what awaits you is bad luck. This chaotic world
is changing the good and evil of human nature.
Agudengba sang a song "Human Nature is
Unpredictable":
Is human nature good or evil?
The dispute has been
inconclusive for thousands of years.
Just because human nature is
unpredictable,
People's hearts are always
separated from the belly.
Who decides the merits and
demerits?
Everything is decided by the
monarch.
The tyrant decides everything
with one word,
Advice that is offensive to
the ears will not be listened to at all.
The world belongs to the
emperor's family,
The powerful and treacherous
ministers are stewards.
Hundreds of millions of
people are married into slaves,
Silence and no thoughts.
The villain is trying to make
a small profit,
The porcelain king seeks
hegemony,
Attacking cities and
plundering territories to create excuses,
Pengci has become
internationalized.
The transformation of human
nature is not what it is today;
It has been the norm since
ancient times,
Read all the vicissitudes of
human history,
The deception and abduction
are endless.
